: Unauthorised layouts regularised under the regularisation of unapproved plots scheme will come under the blanket cover of the Real Estate Act.

The Tamil Nadu Real Estate Regulatory Authority (TNRERA) has sought the commissioner of town and country planning to direct layout promoters, who have applied under the amnesty scheme, to approach the realty regulator to register such layouts.

The move is aimed at protecting the interests of buyers as they can complain to TNRERA in the event of any discrepancies with their plot deviating from the sanctioned approvals.

In a communication to the commissioner of town and country planning, TNRERA interim chairperson said all the layouts regularised by the former’s department must be registered with the real estate regulator.

“Hence, while approving the layouts under the layouts under regularisation scheme, one clause advising the layout promoters to submit application for registration with TNRERA to be added,” the letter said.

According to TNRERA sources, regularised layouts come under the purview of the Real Estate Act. The Tamil Nadu Real Estate (Regulation and Development) Rules, 2017 states that all ongoing housing projects with a minimum of eight units and residential layouts that are meant for sale should be registered with the real estate regulatory authority.

Queried why the TNRERA delayed in bringing the regularised layouts under their ambit though the amnesty scheme was launched more than 18 months ago, the official clarified that the scheme gained momentum only recently.

Meanwhile, S Kanagasundaram, former president of the Association of Licensed Building Surveyors Coimbatore, said the development would provide safety for the buyers. “In fact, it is the only protection layer for buyers of regularised plots as the promoters cannot sub divide the plots violating approvals,” he added.

So far, nearly six lakh applications have been filed in directorate of town and country planning areas covering the entire state, except for the Chennai Metropolitan Area, for the regularisation of unapproved plots scheme.
